Use

These Terms of Use govern your access to and use of the services offered by SYNEX through the website synexstudio.com.br.

By contracting any of our plans or submitting any form on this site, you declare that you have read, understood and agreed with all the conditions described below.

If you do not agree with any clause, please do not contract our services.

• SYNEX: digital agency that creates, hosts and manages websites for small and medium businesses on the Wix platform.
• Client / You: individual or legal entity that contracts SYNEX services.
• Service: creation, hosting and management of websites on the Wix platform under the contracted plan.
• Wix: third-party platform owned by Wix.com Ltd., used as the technological foundation for all client websites, including hosting, editor, CMS, forms, lead capture and analytics.
• Site: the website created and managed by SYNEX for the Client on the Wix platform.
• Plan: the subscription package (Starter, Essential or Pro) or the one-time purchase option.

SYNEX offers a complete service of creation, hosting and ongoing management of professional websites. Every website delivered is built on the Wix platform, using Wix's editor, hosting infrastructure, content management system, lead capture forms, and analytics.

The Service includes:

• Custom design and structure based on the Client's briefing
• Domain and hosting through the Wix platform
• Initial setup of basic SEO, contact forms and integrations available on Wix
• Updates and adjustments requested via WhatsApp, within the limits of the contracted plan
• Ongoing maintenance and security as provided by the Wix platform

Onboarding starts with a short conversation to understand the Client's business and goals. SYNEX then builds a preview of the website on Wix and presents it for approval before going live.

Once approved, the site goes live under a custom domain. From that point on, updates and changes are requested through WhatsApp at +55 (41) 99934-1817, our official communication channel.

Non-priority requests are typically completed within a few business days. Major changes (new pages, structural redesigns, complex integrations) may be quoted separately.

We offer three monthly subscription plans:

We also offer a one-time purchase option, starting at R$ 5.000, where the Client receives the website with full ownership and an independent Wix account transfer.

All prices are in US Dollars (USD). Local taxes may apply depending on the Client's jurisdiction.

Subscription plans are billed monthly in advance. Accepted payment methods are detailed at the time of contracting.

Subscriptions renew automatically each month unless cancelled by the Client through the official channel.

In case of late payment (more than 7 days overdue), the Site may be temporarily unpublished until payment is regularized.

Prices may be adjusted annually based on inflation indexes (such as the IPCA in Brazil), with at least 30 days prior notice to active Clients.

There is no lock-in or fidelity period in subscription plans. The Client may cancel at any time by communicating through the official WhatsApp channel.

The Site remains active until the end of the paid period. After cancellation, the Site is removed from the SYNEX Wix account and goes offline.

If the Client wishes to keep the Site after cancelling the subscription, the one-time purchase option (starting at R$ 5.000) allows full transfer of the Site to an independent Wix account owned by the Client. Talk to us before cancelling if this is your case.

All websites managed by SYNEX are built and hosted on the Wix platform (Wix.com Ltd.). All Client data captured by the Site (form submissions, leads, page analytics) is processed and stored through Wix infrastructure, under Wix's own privacy, security and content policies.

This means the Service inherently depends on Wix's availability, terms, infrastructure and tools. By contracting SYNEX, the Client acknowledges and accepts that:

• Any limitation, downtime, technical issue or policy change by Wix may affect the Service, even though SYNEX will do everything reasonable to mitigate the impact.
• The Client should review Wix's own Terms of Use, available at wix.com/about/terms-of-use.
• Lead data captured through forms on the Site is stored in Wix and managed by SYNEX on behalf of the Client.

The Wix platform itself, its editor and tools remain the intellectual property of Wix.com Ltd. and are not transferred under any plan.

The Client agrees to:

• Provide accurate information for the briefing and any content placed on the Site (texts, images, brand assets, contact details).
• Ensure ownership or legal authorization to use all content provided, including images, logos, trademarks and third-party material.
• Keep payments current and respond to communications within reasonable time.
• Notify SYNEX of any change in contact information, business details or service expectations.
• Comply with applicable laws when using the Site to communicate with their own customers, including data protection laws (LGPD in Brazil, GDPR in Europe, etc.) and consumer protection regulations.

The Client agrees not to use the Service for:

• Illegal activities or content that violates applicable laws.
• Distribution of malware, phishing or unsolicited spam.
• Content that infringes copyright, trademarks or other third-party rights.
• Content that promotes discrimination, harassment, violence or hate speech.
• Adult content or gambling without proper authorization and age-gating.
• Activities that could damage the Wix platform, its users or SYNEX's reputation.

SYNEX reserves the right to unilaterally suspend the Service if a violation is identified, with prior notice when reasonably possible.

Support and update requests are received through WhatsApp at +55 (41) 99934-1817.

An update is defined as a discrete change to text, image, layout or basic configuration of the Site, executed by SYNEX in the Wix editor.

Update quotas per plan:

• Starter: 1 update per month.
• Essential: up to 4 updates per month.
• Pro: unlimited updates.

Unused update quotas do not accumulate or transfer to subsequent months. Major changes (new pages, structural redesigns, complex integrations) may be quoted separately depending on scope.

We strive for maximum availability, but we do not guarantee 100% uptime, as the Service depends on the Wix platform and third-party services beyond our direct control.

SYNEX is not responsible for losses or damages resulting from:

• Wix platform downtime, technical issues or unilateral policy changes.
• Internet connectivity issues, DNS propagation or events outside SYNEX's control.
• Delays caused by the Client's late approval, missing content or unresponsive communication.
• Content provided by the Client that infringes the rights of third parties.
• Loss of business or revenue resulting from indirect consequences of Service interruption.

The total liability of SYNEX in any scenario, regardless of legal basis, is limited to the total amount paid by the Client in the last 3 (three) months of Service.

Data collected through the synexstudio.com.br site is handled according to our Privacy Policy.

The Client's Site (built on Wix) processes data of the Client's own end users under Wix's privacy policy, since lead capture, form submissions and analytics flow through Wix infrastructure. SYNEX manages this data on behalf of the Client.

For LGPD purposes (Brazilian Data Protection Law), SYNEX acts as Controller for data collected on synexstudio.com.br and as Operator for data flowing through the Client's Site, when applicable.

These Terms may be updated to reflect changes in the Service, in applicable legislation or in third-party platforms (such as Wix). The current version is always available at this URL with the last updated date at the top.

Material changes will be communicated to active Clients via WhatsApp or email at least 30 days before they take effect.

These Terms are governed by the laws of the Federative Republic of Brazil.

The courts of the city of Curitiba, State of Paraná (Brazil), are competent to resolve any dispute arising from this agreement, with express waiver of any other, however privileged it may be.
